Contractual Parties

Supplier:HOTEL PARTIZÁN PS, s. r. o. - provider of accommodation, catering, congress, sports, and wellness services (hereinafter also referred to as "hotel") to the purchaser (guest) for a fee.
Operation:Mýto SKI & BIKE Mýto pod Ďumbierom 976 44, Slovak Republic Provider of sports and catering services.
Purchaser:Service orderer - a natural or legal person with whom the supplier enters into a contract (agreement), the subject of which will be the provision of services at the Mýto SKI & BIKE center
These general business conditions of HOTEL PARTIZÁN PS, s. r. o., located at Bystrá 108, 977 01 Bystrá - Tále, registered in the commercial registry of the District Court of Banská Bystrica, section Sro, insert number 24814/S, telephone number 048/6308813, email: ski.myto@partizan.sk (hereinafter referred to as “operator”) for the online shop “Online Ticket Purchase” located at the web address www.kopeczabavy.sk (hereinafter referred to as "business conditions") form an integral part of the purchase contracts concluded in accordance with these business conditions, whose subject is the purchase and sale of online tickets offered by the operator.

1. INTRODUCTORY PROVISIONS

1.1 These business conditions regulate the mutual rights and obligations of the contractual parties arising in connection with the conclusion of purchase contracts through the online store "Online Ticket Purchase" (hereinafter referred to as "online store"), which the operator operates on the website www.kopeczabavy.sk (hereinafter referred to as "website").

1.2 Customers can purchase online tickets through the website of the operator, and the purchase price of the online ticket is paid using the Global Payments payment gateway, s. r. o.

1.3 By purchasing a ticket online, the customer undertakes to respect and comply with these business conditions, as well as the valid and effective Transportation and Travel Regulations of the Mýto ski & bike resort issued by the operator, the text of which is available at the office of the resort administration and also on the website www.kopeczabavy.sk. The sale of tickets online is carried out in accordance with the provisions of applicable legal regulations, in particular Act No. 102/2014 Coll. on consumer protection in the sale of goods or the provision of services on the basis of a contract concluded at a distance or a contract concluded outside the premises of the seller in its valid wording and Act No. 122/2013 Coll. on personal data protection in its valid wording.

1.4 Based on the purchase of a specific type of online ticket, the customer is entitled to use the services specified according to the valid price list for the current season: a) chair lift POMA UNIFIX, Lifts, Conveyor belt b) entry to attractions – MAXI TRAMPOLINE, JUMPING HILL, CHILDREN'S BIKE TRACK, SKILL TRAIL, PUMP TRACK, SUMMER TUBING

2. ONLINE TICKET PURCHASE

2.1. Online tickets can be purchased through the online store by natural and legal persons under conditions further specified.

2.2. It is possible to purchase tickets for the corresponding season according to a valid price list published on www.kopeczabavy.sk.

2.3. Purchase of discounted tickets online is not possible. Discounted tickets can only be purchased in person at the resort's box office during operational hours with the presentation of required credentials.

2.4. Customers proceed with the purchase of tickets through the online store by filling out the mandatory items in the online store form. Specifically, these include 1) selection of the type of ticket 2) chosen form of purchase 3) entry of contact details 4) filling out the start date of the ticket use 5) ticking the agreement with these business conditions, the valid operational regulations of the operator, and consent to the processing of personal data and 6) binding confirmation of order. The binding confirmation of order is also considered as the conclusion of the purchase contract. Subsequently, the customer is shown the total purchase price, which must be paid through the Global Payments payment gateway, s. r. o. The stated purchase price is the final price, i.e., including all fees. By purchasing the ticket, the customer confirms that they have familiarized themselves with these business conditions and agree with them.

2.5. Available forms of purchase: 1) Without registration, whereby no account is created for the customer on the website www.kopeczabavy.sk. 2) With registration, whereby an account is created for the customer on the website www.kopeczabavy.sk upon entering a password. The customer has the option to purchase tickets under more favorable conditions.

2.6. The purchase of online tickets is not conditional on owning a ticket carrier – a chip card from the company AXESS (hereinafter referred to as "chip card"). A chip card will be issued at the self-service terminal upon scanning a QR code.

2.8. It is possible to activate only one online ticket per chip card.

2.9. The use of the chip card and online ticket is governed by the current Operating Regulations of the operator, which are available at the resort administration office of Mýto ski & bike and also on the website www.kopeczabavy.sk.

2.10. Online ticket is valid only for the date set by the customer at the time of online purchase – a specific day at the time of purchase, and its validity ends with the expiration of the duration specified in sec. 2.2. If the online ticket is not used during this specific period without the customer changing the date of validity or withdrawing from the purchase contract according to Art. 4. of these business conditions, the online ticket expires without entitlement to a refund of its purchase price.

2.11. The ticket becomes devalued and personal upon the first passage through the turnstile; thus, it is non-transferable! Only the ticket (ticket encoded on a chip card) is non-transferable, not the chip card as a carrier of the ticket.

2.12. The purchased online ticket is activated after the first passage through the turnstile. After activating the online ticket, it is no longer possible to withdraw from the purchase contract.

2.13. The chip card serves as a travel ticket only after the activation of the online ticket as per sec. 2, item 2.11 of these business conditions. Until then, the chip card does not entitle its holder to ride.

3. PRICE AND PAYMENT TERMS

3.1. The purchase price of online tickets purchased in the online store corresponds to the prices stated in the standard price list of the Mýto ski & bike resort, which is available at all cash desks at the resort and also on the website www.kopeczabavy.sk in the section Pricelist and opening hours.

3.2. The price of goods/services is always paid by the customer to the seller non-cash via the Global payments payment gateway, s. r. o., to which the customer is redirected after confirming the online ticket order. After the payment is made, the customer is informed about its successful or unsuccessful transfer and redirected back to the online store page. If the payment went smoothly, the customer receives an email "Purchase Confirmation" with a proof of payment and the ticket in electronic form with a QR code. The receipt is also a tax document, which the customer is required to keep for possible claims. If the payment was not successful, the customer is informed about the error and redirected back to the last step in the online store. The operator of the Global Payments payment gateway, s. r. o., is fully responsible for problems occurring during the payment and the customer is obligated to address any payment claims with Global Payments, s. r. o. If the customer does not receive an email with a QR code, they should immediately contact the technical support for online ticket purchases at tel. no. +421 907 446 480.

3.3. Shopping via the Global Payments payment gateway, s. r. o., can be done at any time, the system operates continuously except for technological breaks. Customers of the operator will be informed about planned technological breaks in the system and the resulting inability to make payments during this period on his website without undue delay.

4. WITHDRAWAL FROM THE ONLINE SKIPASS PURCHASE CONTRACT

4.1. A customer who purchases an online ticket in the online store more than 14 days before the start of ticket usage is entitled to withdraw from the purchase contract and cancel the ticket without giving a reason within these 14 days.

4.2. When purchasing an online ticket in the online store less than 14 days before the start of ticket usage, the customer is entitled to withdraw from the purchase contract and cancel the ticket, but it must be done at least one day before the start of ticket usage. If the start date of the ticket usage is changed, the customer's cancellation period is extended to a maximum of 14 days from the date of ticket purchase. A ticket with the same purchase date and start of validity cannot be canceled. The customer acknowledges and confirms that if a ticket is purchased on the day of its use, they lose the right to withdraw from the contract.

4.3. Tickets that were not used by the selected start date cannot be retrospectively canceled or have their validity extended, and the customer is not entitled to a refund of the purchase price for these tickets.

4.5. A ticket purchased through the online store can be canceled by email or in writing (in the event of a written withdrawal from the contract, it must be delivered to the operator no later than one day before the start date of ticket usage). Provided that paragraphs 4.1 and 4.2 of these business conditions are met, the customer will have the cash credited back to the bank account from which the tickets were purchased within 14 days of entering the cancellation.

4.6. To cancel a ticket, please send a request via email to ski.myto@partizan.sk. Subsequently, the customer will be informed about the successful cancellation of the ticket and will receive an email "Confirmation of Cancellation."

4.7. In the event of purchasing a season ticket and/or other tickets through the online store, the customer has the right to a return:

- of the full amount of money in the event that the operator is unable to operate transportation devices due to measures taken by the Central Crisis Staff of the Slovak Republic to prevent the spread of the coronavirus SARS-CoV-2 causing the disease COVID-19

- a proportional amount in the event that the operator is allowed to operate transportation devices for less than 30 calendar days due to measures taken by the Central Crisis Staff of the Slovak Republic to prevent the spread of the coronavirus SARS-CoV-2 causing the disease COVID-19 during the summer season 2021.

5. HANDLING AND PROCESSING OF CLAIMS, COMPLAINTS AND SUGGESTIONS

5.1. The operator is responsible for defects that the ticket has at the time it was purchased by the customer, i.e. if it does not match the information stated in the order. The customer is required to check the required data before making a binding confirmation of the order.

5.2. Based on a justified notification by the customer about defects of the ticket, the customer may claim rights arising from defects of goods, for which the operator is responsible. The contracting parties have agreed that the operator is obliged to remove defects of the ticket by providing a ticket that matches the data stated in the binding order or in the email confirming the change of the start date of the ticket usage according to point 2.10 of these business conditions. If it is not possible to remove the defect by providing a ticket matching the order, the customer is entitled to request a discount from the purchase price or withdraw from the contract.

5.3. The customer is entitled to send the operator a suggestion or complaint regarding the provided services by email and the operator will address these continuously and respond to the submitted suggestions or complaints by email within a period of no later than 30 days.

6. PROVIDING PERSONAL DATA

6.1. The customer is required to notify the operator of their personal data requested by the system, including name, surname, permanent residence address, phone number, and email address or business name, registered office address, ID No., VAT ID, VAT number, phone number, and email address.

6.2. The customer acknowledges that the operator processes their personal data for the purpose of fulfilling the obligations of the operator from the purchase contract concluded based on the ticket order and processing these data in the information system, which takes the form of the operator’s electronic customer registry.

6.3. The operator has a legitimate interest in sending messages to the customer about its activities, for the purpose of providing the customer with information about current discounts and promotions.

6.4. Providing information according to § 19 of Act No. 18/2018 Coll. in its valid wording:

b) purpose of processing personal data and its legal basis: - fulfillment of the operator's obligation from the purchase contract concluded on the basis of these General Terms and Conditions and processing these data in the information system, which takes the form of the operator's electronic customer registry, - legitimate interest of the operator in informing the customer about current discounts and promotions,
c) the operator may provide personal data to a person providing accounting services, legal services, technical support and to entities authorized according to special regulations,
d) the operator does not intend to transfer personal data to a third country or an international organization,
e) personal data will be stored for the duration of the contractual relationship and four years after its termination. In relation to data that the operator is required to store longer (for accounting purposes, fulfilling tax obligations and for archival purposes), the operator will store them for the period specified in generally binding legal regulations. Personal data processed by the operator based on legitimate interest will be stored for a period of four (4) years, starting from the day of concluding the contract or granting consent. After this period, they will be disposed of.
g) based on a written request or in person at the operator, you have the right to:
- request access to your personal data and to rectify, erase or restrict processing of your personal data;
- object to the processing of your personal data;
- to data portability;
- at any time revoke your consent to be included in the database of recipients of messages about current discounts and promotions,
- file a proposal to initiate proceedings at the Office for Personal Data Protection of the Slovak Republic. h) the provision of personal data is voluntary, but without their provision, it is not possible to conclude a contract and if the required data is not provided, the contract will not be concluded, i) the obtained personal data is not subject to profiling or automated decision-making.

6.5. In case the customer has registered and created their username and password, they are required to keep these safe and not provide them to a third party. The operator is not responsible for the consequences or damage caused by forgetting the data, providing it to a third party, or failing to secure its protection by the customer.

7. FINAL PROVISIONS

7.1. If any provision of these business conditions is invalid or ineffective, or becomes such, instead of this provision a provision according to the relevant legal regulations, which is closest to this invalid or ineffective provision, will be used. The validity or effectiveness of other provisions is not affected by such a provision.

7.2. In matters not regulated by these business conditions, the rights and obligations of the parties are governed by the relevant provisions of Act No. 102/2014 Coll. on consumer protection in the sale of goods or the provision of services on the basis of a contract concluded at a distance or a contract concluded outside the premises of the seller in its valid wording and the Civil Code in its valid wording.

7.3. The operator is entitled to change or supplement the text of these business conditions. However, this provision does not affect the rights and obligations arising under the effectiveness of the previous text of the business conditions.

7.3. The customer has the right to exercise their rights and claims in an out-of-court manner and for this purpose to submit a proposal to initiate alternative dispute resolution to the alternative dispute resolution entity according to Act No. 391/2015 Coll. on alternative resolution of consumer disputes and on amendment and supplement of certain acts (hereinafter referred to as “ARS”). 7.4. The customer can also exercise their rights and claims through the European Online Dispute Resolution platform, which is available online at http://ec.europa.eu/consumers/odr/index en.htm.

7.5. By purchasing an online ticket, the customer unreservedly accepts all the provisions of these terms and conditions, by which he is bound when concluding the purchase contract, and by checking the box "I agree with the terms and conditions" in the order form for online tickets in the operator's online store, he expresses his explicit consent to these terms and conditions.

7.6. The wording of the terms and conditions, which is available on the operator's website on the day of concluding a specific purchase contract in the online store, is considered valid and effective.
